Smashing Cakes Terms and Conditions of Sale
It is important in our business that we bring to the attention of our customer these general terms and conditions of sales applicable to every order placed with Smashing Cakes.
Placing an order implies both your understanding and acceptance of these general conditions of sale and this will avoid any misunderstandings.
1. Orders and Confirmations
We accept orders placed on our website www.smashingcakes.com.au or by email to briar@smashingcakes.com.au and by phone.
We attempt to ensure we ask you all the details of colour, design, special requirements and delivery however it remains your responsibility to advise us correctly and this information will be detailed on our order confirmation.
All orders will be acknowledged with our order confirmation sent to you, please read and confirm the details within 48 hrs.
Regarding delivery details, these need to be provided to us before the date to be shipped to enables us to schedule a courier.
2. Prices
All prices quoted include suitable packaging for the nominated transport courier for pick up at our premises.
Delivery charges and any return delivery (where goods cannot be delivered for any reason) are not included and are at the customers cost.
All prices shown do not include GST and this will be shown on our invoice as a separate item if applicable.
All orders where GST exemption is quoted must show your tax exemption on your order to us.
3. Delivery
Delivery orders are packed by Smashing Cakes for transport in suitable sealed and shock resistant packaging for road transport.
Orders can be alternatively be collected from the factory by prior arrangement.
If delivery is arranged by Smashing Cakes a handling and delivery charge will apply and will be quoted and shown on our invoice as a separate item calculated on the weight, size and delivery distance as per the couriers quote.
The courier company is responsible for your item once it has left the Smashing Cakes premises.
Please inspect your item immediately upon receipt by you.
If any shipment damage is suspected then report the damage to the courier.
4. Payment
Payment is accepted by PayPal, Visa, MasterCard, or direct deposit into BSB 112 879 Account 479254343
Full payment must be received and cleared by our bank prior to orders being dispatched.
5. Return of Goods
By virtue of the condition that any food material sold by Smashing Cakes is perishable and has a prescribed “use by” date determined by Australian law, you are reminded that goods out of or near end expiry are not subject to return.
Smashing Cakes goods can be inherently fragile to harsh knocks and susceptible to melting at temperatures above 22oC.
It is your responsibility to keep the goods safe from impact, exposure to humidity and temperatures exceeding 22oC or direct sunlight, however we recommend that chocolate not be kept refrigerated and definitely not to be frozen.
Any goods shipped by Smashing Cakes damaged in transit must be notified to us by phone within 24 hours of delivery and a return notice of acceptance will be issued by Smashing Cakes.
Goods damaged after safe delivery to you by the courier are not subject to return.
Goods which have been kept in a shop or out on display, which are damaged or the packaging is opened or soiled so that they are not suitable for resale are not subject to return. Again, food has varying use by dates this could be only a few days or weeks
It is important to note that special occasion events (eg Valentines Day, Mothers Day etc) or festive period products (Christmas, Easter etc) are not subject to return after the period is over.
We respectfully advise that any goods made to order cannot be returned as they will have been made specifically to your requirements.
6. “Others”
Goods Shipped Interstate can be arranged by you and Smashing Cakes will package the product to suit.
For airfreight shipment we recommend your own transport arrangements.
Goods accompanied by Smashing Cakes employee will incur all transport, air travel, accommodation & associated costs
Orders with a value over $1,000 require a 50% deposit together with order
Orders prepared to request are not subject to cancellation or refund and pro rata payment may be required depending on the progress of the order.
7. Cancellations
Any cancellations for any reason must be advised within 7 days of the due date and may be subject to full payment.
8. Disclaimer & Limitation of Liability
Illustrations and images on our website are shown as a guide only. Manufacturing can result in variations to that shown. The depiction of colours is as accurate as reproduction allows.
Smashing Cakes products are handmade and packed in our facility and as such may vary slightly in consistency.
Our website is for the general information to purchase items, and whilst all care has been taken, information on the web site is not to be taken as a substitute for specific advice. We accept no responsibility for any person who acts on the contents of this website.
